DEFINITIONS

Usage Data is data collected automatically, generated either by the use of the Service or from the Service infrastructure itself.

When you access the Service, we may collect certain Usage Data, including, but not limited to, IP address, operating system, unique device identifiers, application debug information, user interaction events, and browsing behavior.

We use Cookies and similar tracking technologies to track the activity on the Service and we hold certain information regarding the Cookies.

Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as beacons, tags, and scripts to collect and track information and to improve and analyze the Service.

RETENTION OF DATA

We will retain and use your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy as well as to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.

For the avoidance of doubt, when you interact with our voice interfaces, we may temporarily process your audio input to provide the Service. Unless explicitly stated otherwise, we do not store raw voice recordings beyond what is reasonably necessary to deliver the Service.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or when we are legally obligated to retain this data for longer periods.

TRANSFER OF DATA

Your information, including Personal Data, may be transferred to – and maintained on –devices located outside of your state, province, country or other jurisdiction where the data protection laws may differ from those of your jurisdiction.

Your agreement to this Privacy Policy followed by your submission of such information represents your consent and agreement to that transfer.

DISCLOSURE OF DATA

(A) Business Transaction

If we are made subject to a merger, acquisition, or asset sale, your Personal Data may be transferred. We will provide prior notice in writing if your Personal Data is transferred and becomes subject to a different Privacy Policy.

(B) Legal Requirements

We may only disclose your Personal Data to a third party in the good faith belief that it is necessary to:

SECURITY OF DATA

We strive to take commercially reasonable means to protect the security of your Personal Data. However, we cannot guarantee the security of your Personal Data, and we do not make any warranties or representations thereto.

SERVICE PROVIDERS

We may engage third-party companies and individuals to facilitate the Service, provide the Service on our behalf, perform Service-related services and/or assist us in analyzing how the Service is used (“Service Providers”).

We shall take reasonable efforts to ensure that these Service Providers comply with applicable privacy laws, and have access to your Personal Data strictly to perform these tasks on our behalf and not to disclose or use it for any other purpose.

CHILDREN

The Service is not directed to children under the age of 13.  We do not knowingly collect, use or disclose Personal Data from children under the age of 13, unless with parental consent and only to the extent necessary to provide educational services upon request. 

If we otherwise become aware that we have inadvertently collected Personal Data from a child under 13, we will promptly delete such information from our records.

If you are a parent or guardian who believes that we may have collected Personal Data from a child under the age of 13, you should contact us at legal@beingai.com, and we will promptly investigate and delete the information, if applicable.

LARGE LANGUAGE MODEL SERVICE PROVIDERS

If we engage third-party Large Language Model (LLM) and related Service Providers in the course of providing the Service to you, where you have provided Personal Data to us, we will take reasonable steps to protect your Personal Data, such as:

  • Data Minimization: Collecting only the minimum data necessary for the LLM to perform the service or function.
  • Data Sanitization: Anonymizing, redacting or masking your Personal Data before engaging the LLM. 

We shall take reasonable efforts to ensure that these LLM Service Providers do not use Personal Data from you or us for any purpose other than to provide the Service to you, including not for training or improving the LLM.

You understand and agree that LLMs can generate inaccurate or misleading information and that the LLM’s output does not constitute medical, legal, financial or professional advice.  You should independently verify any output generated by the LLM.  We explicitly disclaim all liability for any losses or damages resulting from your use of or reliance upon any output generated by the LLM.

You have the right to request an update or deletion of your Personal Data directly where available, or by contacting us at legal@beingai.com.

GOOGLE ANALYTICS

We may use Google Analytics to gain insights into user interactions on the Service. This information may be connected information we have regarding the accounts of other users.

We also encourage you to review Google’s policy for safeguarding your data, available on Google’s website at Google Help > Data privacy and security > Safeguarding your data.

CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

By continuing to access or use our Service after any changes become effective, you agree to be bound by the revised terms of this Privacy Policy.  If you do not agree to the new terms, you are no longer authorized to use the Service and you should terminate your account immediately.

SUPPLEMENTARY MARKET-SPECIFIC PROVISIONS

The supplementary provisions in the following sections may apply in addition to the terms of this Privacy Policy above, depending on which jurisdiction you may be resident in.

(A) If you are a resident of the European Economic Area

Our legal basis for collecting and using the Personal Data described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

(v) The right to data portability – You have the right to be provided with a copy of your Personal Data in a structured, machine-readable and commonly used format.

(vi) The right to withdraw consent – You also have the right to withdraw your consent at any time where we have relied on your consent to process your Personal Data.

(B) If you are a resident of California, USA

We do not sell Personal Data.

You have the following rights:

  • To correct inaccurate Personal Data
  • To opt out of the sale or sharing of Personal Data
  • To limit the use of Sensitive Personal Data
  • To not be discriminated against for exercising these rights

(C) If you are a resident of Japan

We acquire Personal Data through lawful and fair means and do not obtain such information through deception or other improper methods.

We do not collect special care‑required Personal Data relating to medical history, disability, criminal history or social status, unless required by law or with your explicit consent.

You have the right to request disclosure, correction, addition, deletion, suspension of use, or suspension of third‑party provision of your Personal Data.  You can submit your request by contacting us at legal@beingai.com.

(D) If you are a resident of Mainland China

We process your Personal Data only upon the following legal bases:

  • You have provided your consent;
  • It is necessary for the conclusion or performance of a contract, such as to provide the Service under the General Terms and Conditions;
  • To comply with statutory duties or legal obligations;
  • To respond to public health emergencies or protection of life, health or property; or
  • Under other circumstances permitted by applicable law.

Where processing is based on your consent, you have the right to withdraw your consent at any time by contacting us at legal@beingai.com. Withdrawal of consent does not affect the validity of processing carried out prior to such withdrawal.

We do not process any sensitive Personal Data relating to biometrics, precise location, medical, financial accounts or minors, unless with your separate consent and only where necessary for a specific purpose.

  • To access and request a copy of your Personal Data
  • To correct or supplement inaccurate Personal Data

If we transfer your Personal Data outside of Mainland China, we will comply with applicable legal requirements.  These may include conducting security assessments, obtaining relevant certifications, or entering into standard contracts, unless certain exemptions apply.
